A-76 Fair Act / Competitive Sourcing

Introduction

The Office of Management and Budget (OMB) Circular No.A-76, "Performance of Commercial Activities," establishes Federal policy for the performance of recurring commercial activities and implements the statutory requirements of the Federal Activities Inventory Reform (FAIR) Act of 1998, Public Law 105-270.

Circular A-76 is design to balance the interest of the parties to a make or buy cost comparison, provide a level playing field between public and private offerors to a competition, and encourage competition and choice in the management and performance of commercial activities.

It is design to empower Federal managers to make sound and justifiable business decisions. In accordance with the FAIR Act and Circular A-76, each agency must submit to OMB by June 30 of each year, a detailed Commercial Activities Inventory of all commercial activities performed by in-house employees.

The NOAA A-76 Program Manager is responsible for providing management oversight and advice regarding A-76/FAIR Act requirements.

Moratorium on A-76 Studies in the current Appropriation Act: 


SEC. 7 41.  None of the funds appropriated or otherwise made available by this or any other Act may be used to begin or announce a study or public-private competition regarding the conversion to contractor performance of any  function performed by Federal employees pursuant to Office of Management and Budget Circular A-76 or any  other administrative regulation, directive, or policy.
